YouCast365 Terms of Use

1. Agreement and service operator

These Terms govern use of YouCast365, including creator tools, Protect Music, the ledger, licensing marketplace, monitoring, cases, credits, and related services. Questions or legal notices may be sent to support@youcast365.com or 5147 Orange Ave, Port Orange, FL 32127, United States.

2. Accounts and truthful submissions

You are responsible for your account and for accurately identifying every human-authored element, performance, sample, voice replica, AI-provider output, collaborator, license, permission, and ownership split in a submission. Do not impersonate another person or submit material you are not authorized to use.

3. Rights you retain and permissions you grant

You retain any rights you own and any contractual rights validly granted by providers. Uploading material does not give YouCast365 ownership. You grant YouCast365 a limited, non-exclusive license to host, reproduce, transcode, analyze, stream, display, administer, secure, protect, and distribute the material only as needed to provide the features you request.

Commercial marketplace licensing, promotional use, AI training, public syndication, and use of a person’s voice or likeness require separate, specific authorization. You may withdraw an optional authorization prospectively, subject to completed licenses, legal holds, and records YouCast365 must retain to document transactions or disputes.

4. Voice and digital replicas

You may not submit, monetize, license, or promote a replica of another person’s voice or likeness without written authorization covering the requested creation, commercial use, licensing, distribution, territory, and term. YouCast365 may suspend distribution, monetization, and payouts while consent is reviewed. Revocation and impersonation reports receive a separate voice/likeness review and are not limited to copyright remedies.

5. Protect Music and the Protection Warranty

YouCast365 protects every legally and contractually protectable layer of AI-assisted music. The selected tier may include evidence preservation, record integrity, provider-license verification, voice-consent review, internal platform enforcement, response-time commitments, filing assistance, external-notice assistance, a stated capped Protection Support Benefit, and a stated service-failure remedy.

YouCast365 creates a signed, tamper-evident Rights & Provenance Record and documented chain of custody. It does not issue a government copyright registration or determine ownership or infringement. Government registration, court rulings, third-party platform decisions, distributor acceptance, revenue, and recovery are outside YouCast365’s control and are not guaranteed.

6. Complaints, disputes, and holds

Copyright, unauthorized voice/likeness, provider-license, duplicate registration, ownership/collaborator, impersonation/fraud, sample/beat, and royalty/metadata disputes follow separate review routes. YouCast365 may preserve evidence, restrict visibility, suspend licensing, and hold earnings while a dispute is reviewed. A technical match alone is not a legal conclusion.

7. Removal and retention

YouCast365 does not charge a removal fee for valid copyright, privacy, unauthorized voice/likeness, impersonation, unlawful-content, or legally required deletion requests. Some audit, transaction, license, fraud-prevention, dispute, legal-hold, and financial records may be retained when legally permitted or required. Retention of a record does not authorize continued public use of removed content.

8. Marketplace and payments

Sellers may grant only rights they control. Each license must state the work, parties, use, media, territory, term, exclusivity, attribution, edits, sublicensing, AI-training status, allowlists, and price. YouCast365’s marketplace commission is 20% before separately disclosed processor fees, taxes, reserves, refunds, chargebacks, and payout adjustments.

9. Credits and service failures

Credit costs appear before confirmation. A failed paid action caused by a verified YouCast365 platform error will be recredited or remedied under the applicable service terms. Statutory consumer rights are not waived.

10. Prohibited conduct

Do not infringe rights, bypass access controls, scrape without authorization, submit deceptive evidence, falsify consent, manipulate plays, evade enforcement, or use the service unlawfully. YouCast365 may remove content, suspend accounts, preserve evidence, and cooperate with lawful process.

11. Disclaimers and liability

Except for an express written Protection Warranty or other written service commitment, the service is provided as available to the extent permitted by law. Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded.

12. Governing law and contact

These Terms are governed by applicable United States federal law and the laws of the State of Florida, without regard to conflict-of-law rules. Royalty & Rights Administration

A Protection Record is evidence and rights metadata; it does not create a statutory royalty entitlement or make YouCast365 a collecting society.

Royalty & Rights Administration is available only where the creator accepts a separate written or electronic work schedule identifying the right, work, territory, term, ownership splits, administration scope, and fee. YouCast365 may submit metadata, administer or collect only within that scope, and may not imply that a detection, view, catalog reference, or registration creates money.

Only money actually received from an identifiable licensee, distributor, platform, collection partner, or settlement and matched to the work is posted to the collections ledger. Reported, estimated, unmatched, disputed, reversed, refunded, or charged-back amounts are not available for payout. Creator balances are cash accounting records and are never YouCast365 credits.

Marketplace license revenue is subject to the published 20% YouCast365 commission. Any external royalty-collection commission, third-party cost, tax, reserve, refund, chargeback, or withholding must be disclosed in the applicable agreement. Payouts use Stripe Connect after identity, tax, rights, and fraud checks.

The Royalty & Rights Administration Agreement controls over a conflicting general upload term for an enrolled work. The general upload license is limited to hosting, technical processing, evidence preservation, security, and the features the creator requested. Distribution, sync, advertising, voice licensing, commercial sublicensing, and external administration require separate affirmative authorization.
