YouCast365 DMCA Notice

YouCast365 respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the YouCast365 service (the “Service”) that are reported to our Designated Copyright Agent, identified in the sample notice below.
1. Notification of Infringement
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Upon receipt of the Notice as described below, YouCast365 will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Service.
DMCA Notice of Alleged Infringement (“Notice”)

Identify the copyrighted work that you claim has been infringed, or—if multiple copyrighted works are covered by this Notice—you may provide a representative list of the copyrighted works that you claim have been infringed.
2.
Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the Service where such material may be found.
3.
Provide your mailing address, telephone number, and, if available, email address.
4.
Include both of the following statements in the body of the Notice:

“I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”

“I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
5.
Provide your full legal name and your electronic or physical signature.

2. Counter-Notification Procedures
If you believe that material you posted on the Service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting a written notification to our Designated Copyright Agent (contact information above) that includes substantially the following:
1.
Your physical or electronic signature.
2.
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
3.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
4.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which YouCast365 may be found, and that you will accept service of process from the person who provided the initial DMCA notification or an agent of such person.
Upon receipt of a valid counter-notification, YouCast365 will provide the complaining party with a copy of the counter-notification. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notification, at YouCast365’s sole discretion.
3. Repeat Infringers
YouCast365 will terminate, in appropriate circumstances, users who are repeat infringers of copyright. We also reserve the right to cease any and all credits associated with User AI Content found to be infringing upon the intellectual property rights of others, as detailed in our Terms of Use.
4. AI Content and Copyright
YouCast365 is a platform that facilitates the creation and sharing of AI-generated content. Users are solely responsible for ensuring that their User AI Content, including any AI-generated music, voice clones, or radio station content, does not infringe upon existing copyrights or other intellectual property rights. By uploading AI content, you represent and warrant that you have all necessary rights, licenses, and permissions for its use and distribution on YouCast365.
5. Unauthorized Access to AI Radio Stations
Unauthorized access to or reproduction of AI radio stations or other proprietary AI content on YouCast365 is strictly prohibited. Any such activity will be treated as a violation of our Terms of Use and may result in account termination and legal action.
