# YouCast365 Terms of Use

Welcome to YouCast365! These Terms of Use (“Terms”) govern your access to and use of the YouCast365 website, applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
## 1. Acceptance of Terms
By creating an account, accessing, or using any part of the YouCast365 Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our DMCA Notice. These documents form a legally binding agreement between you and YouCast365. We may update these Terms from time to time, and your continued use of the Service after such updates constitutes your acceptance of the revised Terms.
## 2. Your YouCast365 Account
### 2.1 Account Creation and Security
You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify YouCast365 immediately of any unauthorized use of your account. YouCast365 will not be liable for any loss or damage arising from your failure to comply with this security obligation.
### 2.2 Prohibited Usernames
Users are prohibited from creating usernames that falsely represent involvement with YouCast365, including but not limited to names such as “YouCast365Staff,” “you_cast365,” “youcast,” “youcastceo,” or any similar variations. YouCast365 reserves the right, at its sole discretion, to remove, rename, apply fees, or cease earnings from accounts found in violation of this provision.
## 3. Content on YouCast365
### 3.1 User-Generated AI Content
Users may submit, upload, publish, or otherwise make available AI-generated content, including but not limited to AI-generated music, voice clones, and radio station content (“User AI Content”). You retain all rights in, and are solely responsible for, the User AI Content you make available through the Service.
### 3.2 License to YouCast365
By submitting User AI Content to YouCast365, you grant YouCast365 a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, perform, and otherwise exploit the User AI Content in connection with the Service and YouCast365’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. This license includes the right for YouCast365 to use and profit from your User AI Content as it sees fit, including but not limited to monetization through advertising, subscriptions, and syndication.
### 3.3 Preference for Cloned AI Artists
YouCast365 encourages the submission of User AI Content that features cloned AI artists derived from real voices and real people. By submitting such content, you affirm that you have obtained all necessary rights, licenses, and permissions from the original voice actors or individuals whose likeness is used. You grant YouCast365 the right to use their likeness and content as YouCast365 sees fit in connection with the Service, including for promotional and commercial purposes. While we value all creative contributions, content featuring AI artists cloned from real voices and people may receive preferential treatment or exposure within the Service due to its unique appeal and potential for deeper engagement.
### 3.4 Content Removal Fees
User AI Content, once added to YouCast365, becomes an integral part of the Service’s ecosystem, contributing to its overall traffic and user experience. Therefore, YouCast365 reserves the right to charge a reasonable fee for the permanent removal of any User AI Content. This fee is intended to compensate YouCast365 for potential losses in traffic, engagement, or other commercial value that may result from the removal of content that has become part of the platform’s offering. The specific fee structure will be communicated to the user upon a removal request.
### 3.5 Unauthorized AI Content
If users are found uploading AI content to which they do not possess the necessary rights, YouCast365 reserves the right to cease any and all credits associated with such content. “Credits” on YouCast365 represent a form of dollar tender within the Service.
## 4. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
a. Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
b. Uploading or transmitting any User AI Content that infringes upon the intellectual property rights of others, or that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
c. Attempting to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service through hacking, password mining, or any other means.
d. Interfering with or disrupting the integrity or performance of the Service or data contained therein.
e. Creating or transmitting unwanted email, spam, or other unsolicited communications.
f. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
g. Scraping, crawling, or otherwise extracting data from the Service without explicit prior written permission from YouCast365. Violators of this provision may be pursued through litigation at the discretion of YouCast365.
h. Accessing or attempting to access AI radio stations or other features of the Service without proper authorization.
## 5. Credits and Payments
### 5.1 No Refunds on Credits
All purchases of credits on YouCast365 are final and non-refundable. Once credits are purchased, they cannot be exchanged for cash or any other form of tender outside of the YouCast365 Service. By purchasing credits, you acknowledge and agree to this no-refund policy.
### 5.2 Payment Processing
All payment transactions for credits and other services are handled by third-party payment processors, including but not limited to Stripe and PayPal. YouCast365 does not store your full payment card details. Your use of these third-party payment processors is subject to their respective terms of service and privacy policies. YouCast365 is not responsible for any issues or disputes arising from your transactions with these third-party processors.
## 6. Disclaimers and Limitation of Liability
### 6.1 Real-Time Chat Disclaimer
YouCast365 provides real-time chat functionalities to facilitate user interaction. YouCast365 is not responsible for any content, statements, opinions, or information expressed by users in these chat environments. Users are solely responsible for their communications and interactions. YouCast365 does not endorse, support, or verify the accuracy of any user-generated chat content and disclaims all liability related thereto.
### 6.2 Light Sensitivity Disclaimer
YouCast365 offers both light and dark mode options to accommodate users with varying preferences, including those who may be sensitive to bright lighting. However, YouCast365 is not responsible for any discomfort, adverse reactions, or health issues experienced by light-sensitive users, regardless of the chosen display mode. Users are advised to adjust their device settings and take appropriate precautions based on their individual needs.
### 6.3 No Guarantees
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. YouCast365 makes no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
### 6.4 Limitation of Liability
To the fullest extent permitted by applicable law, YouCast365 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not YouCast365 has been informed of the possibility of such damage.
## 7. Indemnification
You agree to defend, indemnify, and hold harmless YouCast365 and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your User AI Content caused damage to a third party.
## 8. Governing Law and Jurisdiction
